In the case of direct or indirect references to third-party websites ("links") that are beyond the provider's scope of responsibility, a liability obligation would only take effect (in accordance with § 5 (2) TDG) in the event that the provider is aware of the content and it would be technically possible and reasonable to prevent the use of illegal content.

The provider hereby explicitly declares that at the time the link was set, the relevant linked pages contained no obviously recognizable illegal content. The provider has no influence on the current and future presentation and content of the linked pages. Therefore, the provider hereby explicitly dissociates from all contents of all the linked pages that were changed after the link was set.

This statement applies to all links and references set within the company's own website as well as to third-party entries in guest books, discussion forums, and mailing lists set up by the provider. For illegal, incorrect, or incomplete content, and especially for any damage resulting from the use or non-use of such information, the provider of the linked page alone is liable, and not the person who merely provides a link to the respective publication.
